It was very unfortunate, unexpected and his bad-luck to be arrested at San Antonio Airport, as the security misunderstood his MP3 Music Player to be a suspicious device. (Please Note that all the Names of the Concerned Officers to this incident are Listed at the end of this Article). The security also evacuated the airport and canceled the flight and the incident was shown on CNN and Fox News. Soon the incident was popularized with lime-lite (Please watch youtube video below). It was a terrible and horrible scene that was created by the security.
Three days before this incident, the Homeland Security (uscis) had approved his visa transfer from L1 (work visa) to F1 (student visa). They arrested Mr. Kargudri on 26th of August 2008 sometime in the morning 10.30 AM, and after keeping him at the lockup in the airport basement till evening 7 PM, the FBI and ICE informed him that his previous expired L1 visa was a fraud. It was unbelievable for him, as he was wondering, how would the Homeland Security (uscis) approve the visa transfer if it was a fake. It was a negligence of inquiry and verification by Homeland Security which created all these problems.
He had very much specified the previous company address and contact details in the visa transfer application form, so that they would contact the concerned for verification. He only came to know, the complete detail of fraud when he received his DISCOVERY documents at prison, after four months of his arrest. It had a big list of persons who were the victims of this situation back in India in 2005. He never even had a clue about the intensity of fraud. All he had thought was the person in India had given him a genuine visa and had made some money out of it. This visa was approved by US Embassy in India(Delhi). He thought the issuing person had not informed the head office at United States regarding his L1 visa, as he had told Mr. Kargudri that he was a TEMPORARY worker. As the issuing person was not replying his calls and the L1 visa was expiring. He thought of doing his MASTERS which would create a better future and career. He had also tried to transfer L1 to H1 twice, but it did not go through due to the lottery system. He would have returned back to India if the Homeland Security would have REJECTED his application, as he would have been out of status. It was a sudden surprise and also confusion for him, the way the things happened at the airport. Not even a single officer listened to his justification. It was a miserable and a helpless situation for a poor and weak person like him, in front of the HUGE Federal System. The powerful immigration officers had not only kept him in detention prison, but also had forcibly imposed a CRIMINAL FELONY with six months sentencing of imprisonment, with false charges for specifying the CORRECT address information in the visa transfer application.

Here are a few simple and common sense questions, which arise in our minds, which are to be answered by the immigration authority. There are millions of illegal immigrants in US who do not have any documentation and do not know to speak English. Why did the immigration deport him before deporting these millions of illegal immigrants? Comparatively he is not the worst of all these illegal immigrants. In fact he is one of the best of all the legal citizens. He is not the real culprit but one of the victims of the corrupt immigration system who issued him a visa by making corrupt money. He was wrongly assured of the genuine visa by the issuing authorities. He was innocent and never had any doubt nor suspicion of any visa violations.
It is quite true that there are millions of illegal immigrants in US. The question remains unanswered, as to who is responsible for the reason of their migration to USA? It is very important to NOTE that these are poor people broken financially. They are hard working and intelligent but job less. They are the victims of selfish manipulative materialistic society. They are looking for some money to live their lives. Why would they come to US if they were able to lead a happy life, back home? Question: Is it proper to invade Mr. Kargudri's privacy by posting his name on internet. Are they not invading his privacy? Why would the "Director of National Security Policy Janice Kephart" ( http://www.cis.org/Kephart ) intentionally post these videos on the internet. Who advised her to take these actions? Is she not hurting his reputation?
By searching Mr. Kargudri's name on GOOGLE one can understand how US Media is Exploiting his Privacy even TODAY. The only option is to claim Compensation for these losses through legal proceedings.
Was it mandatory to arrest him with Handcuffs at airport while he was traveling within US after determining that he was not a potential threat? Is it not illegal to rip open his bags and personal belongings at the airport. Is it appropriate to check his passport's expiry date? As it is not necessary to carry ones passport while traveling within US, any valid ID would be fine. Why did they not let him go when they had confirmed that he was not a potential threat? What was the reason to file Court Charges against him and to Imprison him for Six Months?
Why did CIA file Court Case against him with these Charges?
Charge (1): Staying with an expired Passport.
When an expired passport can be renewed with a late fee, as he had forgot to renew it. Was it a potential crime for imprisonment / deportation?
Charge (2): Visa Work Violation.
This is for working in Minimum Wages Jobs, like working in Dunkin Donuts. Was it illegal for him to earn his bread with hard work. It is the minimum wages he had worked for a part time job. There are millions of student workers in US who adopt the same part-time work to take care of their expenses.
Charge (3): This is for specifying Address information in L1 to F1 visa transfer application form.
He had obviously specified the Office Address which belonged to his previous visa. (The reason being he was not aware of any visa frauds before the incident). Why would the Vermont USCIS approve the F1-student visa in 2008, if the previous L1-visa issued in 2005 was a fake. What difference does it anyway make, when the previous L1 visa Company name is already specified in stamped visa in the passport. Does it mean to say that Airport Security is much smarter than Homeland Security USCIS?
He was in United States for almost four years. His visit to US was not fruitful nor a pleasant one. He sometimes wondered, as to what was the driving force which made him visit US. He visited USA as he had a false image, or rather a wrong image, that everything was perfect and unique in US. Since his childhood when ever he saw SUPERMAN, SPIDERMAN, CARTOONS, INVENTIONS on televisions, Astronomers on MOON, UFO’S from space, The ROBOTS, FIGHTER PLANES, NUCLEAR technology, High graded SOFTWARE, BIGGEST BUSINESS TYCOONS, Worlds richest PEOPLE, The RICHEST country, The most POWERFUL as interpreted my MEDIA.
Apart from all these, he being a fast learner, a calm, gentle and a humble person since his childhood, who was fortunate enough to be born in a well educated, well to do, smartha Brahmin family. Was fortunate enough to have a grandfather who was a Doctor, his only son being his father, who inherited his property, back in Karnataka.
He was fortunate enough to have a huge garden with varieties of fruits and flowers in the front yard, along with a German Shepherd to play with. To be educated in English School since his nursery back in those 1980’s. Which very much gave him a false impression of US being a SUPER POWER.
He thought there was no unemployment in US. He thought US was a great country which had a GREAT purpose, to serve the HUMANITY, MANKIND, JUSTICE, LIBERTY and FREEDOM.
He thought people in US were intellectuals, He thought they were spiritually balanced with Calmness, Gentleness and Humbleness.
He thought there was Respect and Dignity to Human beings irrespective of Cast, Creed, Race or Religion. He thought there was Transparency and Appreciations for Good Quality Human beings.
Any Intellectual who has recently visited US, and who is balanced with justice, who meditates for reasoning and solutions, will certainly say one TRUTH, that US has lost its very purpose of leadership. It’s very purpose to serve the Mankind.
People in US have become very arrogant, Greedy, Wicked, Self-centered, with an ego of superiority to accomplish Bad Desires and Bad Ambitions. Moreover very Materialistic and Practical environment.

He was Graduated with B-Tech (Bachelors of Engineering) from a reputed University in the Year 1996, after which he had a experience in Civil Constructions and Software Development of almost 4 + 10 years. A sudden transformation took place in his life when his Father Passed away due to a HEART ATTACK in the year 2004. This was due to a huge loss in his Business. He was confirmed that all his property which was hypothecated (pledged) in the banks (Finance Institutions) were overtaken. Nothing had left behind for him to inherit. He was on the streets, with no property nor help, nor blessings, unmarried, with no support from elders or relatives. That time he was working with TATA’s in Software Development Center at Bangalore. To obtain financial stability, he was looking for job opportunities abroad. In 2005 one of the company’s in Bangalore named Honeywell offered him a L1-Visa to US. Being a optimist and positive minded, he took this opportunity thinking it to be a Blessing to attain his Financial Stability. He submitted all his papers with US Embassy, underwent an Interview and was approved a L1-Visa. He was told that this was a “Temporary Intra Company Transfer Visa” and thus it would not provide any job security in US, as he was not yet confirmed as an Permanent Employee of this Organization. Thus he was told before in hand that he was supposed to find a sponsor to transfer this L1-Visa into an H1-Visa or Green Card.
The first place he landed in US was New-York City. After landing in US. He applied for his Social Security. Which was approved by the SS-office. He also received his ID Card / Drivers License from NY Driving Authority. He stayed at Flushing near Hindu-Temple and also worked at one of the Dunkin Donuts to startup with, just to take care of his expenses, until he got a Software Job. Fortunately one Mr. Ashok Abhyankar aged in his 70’s offered him a Software Assignment and promised to pay him salary and also promised to process his H1 and Green Card. This person betrayed him later of his salary and did not help in processing his papers, and is still to pay him his hard earned salary of 9000 US$. He expressed his great concerns to many elderly persons in Hindu Temple Society, but in vain, none of them were helpful. At that very moment, due to Bush policies, US was at war, with a broken economy and a broken Govt. Every one was terrified with fear and terror. There was lots of anger, hatred and frustrations among people. It was also too cold in NY during winters, thus he thought of moving to a warmer region.
After almost staying in NY for 12 months, he moved to Dallas-Texas, to be in a warmer climate. He thought downtown Dallas would be helpful in searching software jobs. But again in vain none of them helped. He was introduced to Mr Mahesh Gopalakrishna here at the Dallas Hindu Temples. Who is a business man owning a few Motels there, and also owns Software firms back in Blore-India. He offered him a small job just to take care of his expenses and promised him to renew his H1. By this time he had almost tried two times to transfer his L1 to H1, every year, and was not-approved due to the lottery system. As his L1-Visa was valid only for three years, it was about to expire in 2008. Thus, as advised by Sunita Shivaram, who is CEO of Immigration Consulting Firm, based at Atlanta-Georgia, he applied for his Student Visa (F1), with one of the local colleges. FORTUNATELY the USCIS (Homeland Security) APPROVED his Student Visa. After four days of receiving his Student Visa (F1) approval, he was traveling within US from Dallas to Virginia, as the Colleges at Virginia were comparatively much cheaper than Texas. He was supposed to fly to Virginia. He went for a cheaper flight ticket which was not a direct flight but a split one. As the direct flight would cost him $300, he took this connecting flight for $200, that is from DALLAS to SAN-ANTONIO and from San-Antonio to Virginia (two flights) with a break of an hour in-between.
Next day Early morning, he took his bags, called a taxi, took his first flight from Dallas to San-Antonio. In San-Antonio while he was changing his flight, he had to recheck his bags at the security. While checking his bags, the security at the airport opened his bags and found his MP3 (music player) which he had connected to a rechargeable battery. Due to suspicion, they misunderstood it to be a suspicious device which could blow up.
They made a BIG scene, by evacuating the airport, and by cancelling the flight, thinking that it would blowup.
This incident was also shown on TV, FOX-News and CNN-News. This had already got the attention of the media, and the incident was questioned by the higher officers. None of the security persons were ready to accept that it was their mistake to cancel the flight and to delay the inconvenience to hundreds of passengers. This incident also created a financial loss to the private airlines, which was supposed to take off to Virginia. All these powerful officers passed on the blame to him, and started to cross check his documents, just to pass the blame on to him and to prove that, he was the cause of these huge financial losses. Unfortunately his passport which was issued in 1998 and was valid for 10 years, had expired in 2008, just one month before this incident. They also found out that he had worked at coffee shop Duncan Donuts. They told him that his L1-Visa, with which he had arrived in US (in 2005) was a fake. Everything was a great shock to him. He was wondering as to what had gone wrong. He was wondering, how would he get his approval for F1-student visa if his previous L1-visa was a fake, (obviously USCIS would have rejected it, if it was a fake). He also requested them that he would renew his passport from Indian Embassy by paying the late penalty fine/fee. But the officers never wanted to let him go. Within few HOURS, his life was DESTROYED, his career and his future was blacklisted. They imposed Court Charges on him, arrested him and was imprisoned behind bars. Finally deported back, with a penalty.
He was a weak, helpless and a miserable VICTIM of this Powerful, FBI, Immigration CIA, US Legal Law and Courts System.
He finally returned back with all his dreams shattered, without any financial stability. At the age of 37, Still looking for his Life-Partner without any home to stay.

The Federal and ICE system of United States has treated him pretty badly. It has been a humiliation, hurtful and painful torture for nine months (from 26th of August 2008 to 22nd of July 2009). He did not have any blood relations in United States at that time and had lost his beloved father in 2004. He had many of his friends, relatives and cousins in United Sates but none of them took any initiative, nor helped him, either morally or financially. No one was sending him any money, thus it is a miserable situation to survive in this detention facility. In such a critical situation it is quite obvious that the Indian Embassy must be helping the fellow Indians who are in painful miserable situation. We hope and pray everyone, to take courage and initiative to help all the poor, miserable and helpless Indians who are the victims of this federal justice system. This system has lost its very purpose of life. The people working in this system, especially in Texas, have lost their moral values, character and discipline. It has become a corrupt, wicked and greedy money making system. It is torturing the poor, helpless, week, miserable, hardworking people in the name of Law and Order. He was unable to hire any attorney as he did not have any money. He could not save any money due to a BROKEN ECONOMY. None of the non-profit organizations, human rights and public defenders in Texas ever helped him. None of them had any courtesy, kindness and humanity towards the poor and helpless victims. We could see that every one was interested only in making money with fear, hatred, anger and torture. They have manipulated the security, law and order to implement torture. The system is injecting fear in the hearts of poor people. It is hurting the fellow people with a painful torture. The poor people have been deprived of their basic human rights. None of the organizations and institutions were helping. The government is mismanaged and the economy was broken. We humbly and kindly request everyone to help him in this miserable situation. The detention center was a prison where in they were locked behind iron doors for no proper reason. Even a small delay in processing the travel papers will terribly affect the freedom of the individual. Please help to speed up the process and help them to lead a respectable life with dignity. Making a phone call is expensive and painful. Every phone call is recorded and monitored. Thus everyone is afraid of this system and thus are not helping and communicating. In such a miserable situation Indian Embassy is the only ray of hope to help and protect its fellow Indians. It is definitely a blessing to help the innocent and poor fellow Indians. We pray the lord to give you all the strength and courage to help them all.
The CIA made him wait at prison for his TRAVEL DOCUMENT as his passport expired on July 2nd 2008. That is just one month before his arrest in August 2008. As he was in detention, it was not possible for him to personally visit the Indian Embassy or passport office. Thus he had no idea of the procedure to renew his passport, the fees required and all the documents required to renew the same. His only intention then was to be released from detention as quickly as possible. He intended to know which one was quicker, either Passport Renewal or Travel Document. He also heard that the customs officers in India will create problems when any Indian is deported with Travel Documents. Thus he needs to be guided if it is better to renew the passport rather than issuing the travel documents. A delay of every single day would help the prison to make money by keeping the detainees. Thus any delay by Indian Embassy will be encouraging and contributing this corrupt system in making dirty money.
He does not know what he would be doing after returning back to India. As his beloved father had a heart attack due to a heavy loss in his business. Thus he has lost his blessings and also his property. He will be on the streets. He could not save any money in United States due to a broken economy. Many U.S citizens who had given him temporary employment did not pay him the promised amount. Thus he is still to receive his hard earned payment past three years. In such a miserable and helpless situation no one was helping him. Everyone was making money with a wrongful means. They were greedy, wicked, cunning and manipulative. We remember a quote saying “There is nothing wrong in creating wealth, but all that matters is how it is created”. There is blessings when the wealth is created with Love, Compassion, Brotherhood and Caring. With a constructive measure to serve the Humanity with a good purpose of life. When the same wealth is created with Fear, Terror, Hatred, Anger, Frustration and Enmity, it creates a destructive surroundings with a loss of moral values, character and discipline. Thus the very purpose of life to serve the humanity is lost.

But in today’s life, highly educated, hardworking, humble and innocent persons are being tortured and have been deprived of their basic human rights. The good constructive people have been the victims of the bad destructive individuals, who are self centered, wicked and greedy. Who have created wealth with a wrongful means. Instead of arresting the rich, corrupt, manipulative and destructive culprits. The justice system is arresting the innocent, week, poor and helpless people. After all this we do say “In God we Trust”, which does not make any sense, as the Devil is controlling the God. We can see the real difference and CHANGE only when the good people who are poor, helpless and miserable are appreciated and helped by the powerful, magnificent federal system. His arrest at the San Antonio airport:
On 26th of august 08 he was traveling by air flight from Dallas (dfw) to Virginia (iat), this was not a direct flight, thus he had to change flights at San Antonio (sat). He departed from Dallas at 9 am by American airlines (1179) and arrived at 10 am in San Antonio. He was supposed to change flights to united airlines (5348) to depart at 11 am and arrive at 4 pm in Virginia. While in San Antonio airport, the security officer Mr. Travis Thornton and customs enforcement while scanning his bags, due to suspicious misunderstanding opened his bags and misunderstood his mp3 music player which was connected to rechargeable battery to be a suspicious device. He was arrested at the airport and all the public at the airport were evacuated. Bomb appraisal officer Mr. Chris Stallcup was enforced to identify the suspicious device. The united airline (5348) which was supposed to depart San Antonio and reach Virginia was cancelled assuming a security threat by the authorities. The security handcuffed him at 11 am approx and had kept him at the airport basement lockup cell until evening 8 pm. When the FBI agents (Mr. Jason Hudson, Mr. Larry Koleff, Mr. Garry Simons, Mr. James Moss) along with ICE agents (Mr. Jose Flores, Mr. Jose Ortega, Mr. Daniel Pearles) informed him that his old L1 visa issued in 2005 was a fraud. He told them that he had already transferred his L1 (work visa) into the F1 (Student Visa) with Grayson County College, and the same was approved by the Homeland Security (USCIS) a couple of days before this incident. He was wondering as to how he would get the F1 approval if his L1 visa was an alleged fraud. Later they started verifying all his documents and bags.
Criminal Charges Imposed by FBI and ICE:
The FBI and ICE at the airport told him that the Honeywell in US does not recognize his employment. They said that his visa was not valid and was a fraud. They asked him if he had worked with Honeywell in US. And asked him to give some references of Honeywell Employees.
He told them that, he had not worked for US office and thus did not recognize anyone in US. He was himself a victim of this situation. He was working for his Indian Honeywell employee who had misguided him by making false promises of getting him a project assignment in United States. He had asked him to wait until he had got him projects in United States, matching his skill sets. He was eventually waiting for project allotment in United States, but never received any of them. As his previous visa was expiring he transferred his L1 (work visa) into F1 (student visa) after consulting Sunitha Shivaram and he received his approval for the same from homeland security on 23rd of august 2008. He was not informed by them regarding any visa frauds. As he had specified the Honeywell address in United States, in his visa transfer application form. As they would have not approved his visa transfer if the L1 visa was an alleged fraud and eventually he would have returned back to India. On receiving the approval, he was confirmed that the homeland security had eventually verified his work address and other related records.
The FBI and ICE questioned him as to why had he specified the address of Honeywell in united states, in the F1 visa transfer application (I-539) when he had never worked for them in united states.
He told them that, he had specified their address as the same was specified in his previous old L1 visa application records. This would help them in verification of documents.
The FBI and ICE told him that it was a crime to specify the address of Honeywell in United States, when he had not worked in that specified address. Where as he thought that he had done the right thing by specifying the truth, so that they would do proper verification. The ICE offered him to sign the deportation agreement after his arrest, but he did not sign the same as Sunitha Shivaram had assured him not to sign any documents with ICE. After which ICE and FBI charged him with the criminal case for “False swearing in immigration matters” with United States district court.
Why was he staying in United States?
His visa transfer approval from L1 to F1 from Homeland Security (uscis) was itself a genuine credible proof for him to extend his stay in United States, as he would have returned back to India if the Homeland Security (uscis) would not have approved his visa transfer.
The visa transfer from L1 to F1 would have not been approved by the Homeland Security if the L1 visa was a alleged fraud as stated in the indictment. Neither the FBI nor the Homeland Security ever informed him before regarding any of the visa frauds. They did not even reject his F1 student visa, as he would have NOT stayed in United States if his L1 to F1 visa transfer was NOT APPROVED by the Homeland Security (uscis). He was staying in United States with an assumption of a valid visa status.
In several occasions like:
When he received his Social Security from New York in the year 2005.
When he received his New York State ID in 2006.
When he received his Texas State Drivers License from Sherman TX in 2007.
When he received his F1 student visa approval in august 2008.
In any of the above situations, he was never informed by the FBI or ICE or Homeland Security regarding the visa fraud. He never had a clue. What makes us wonder is that he would have returned back to India if they would have informed him before in hand. It was absolutely not necessary for them to hurt and torture him with criminal court charges. As this felony will effect his future career and his humble purpose of life in United States. As this will avoid him from returning to United States in the future with a legal visa status. Thus he also requested the honorable judges Marcia A Crone and Don Bush, Public Prosecutor Ernest Gonzales, ICE Agent Jeanna Schaare to direct the ICE to dismiss and withdraw the criminal charges. As he was himself a victim in this situation, as he was misguided by the Honeywell Employee who issued him the invalid L1 visa in India in the year 2005. We still do not understand why the United States Embassy in India approved this particular L1 work visa in the year 2005.
His time spent at the detention centers:
He was kept in detention since 26th of august 2008 until 22nd of July 2009. On 11th of September 2008 magistrate judge Mr. John P Primomo and federal defender Mr. John (Jack) Carter at San Antonio TX transferred the court case to Eastern District of Texas (Judge Marcia A Crone and Judge Don Bush, Jeanna Schaare – ICE Agent, Federal Defender Denise S Benson, Prosecutors Ernest Gonzales and Rebecca Gregory at Sherman TX).
He was kept at GEO detention facility at San Antonio from 26th of august 2008.
On 29th of September 2008, he was moved to federal transfer center at Oklahoma City.
On 8th of October 2008, he was moved to hunt county detention center at Greenville TX.
He underwent an interview with probation officer Christin Cormier (Assistant of Mr. Paul Hennen) for my PSI on 20th of February 2009 at hunt county detention center.
On 2nd of March 2009, he was moved to red river county detention at Clarksville TX.
On 25th of March 2009, the court sentenced him for six months with United States marshals (from 3rd of September 2008 to 3rd of March 2009).
After spending 40 days of excess time with United States marshals, he was transferred back to ICE custody on 9th of April 2009.
On 10th of April 2009, he was moved to rolling plains detention at Haskell TX for deportation with ICE.
On 23rd of April 2009, he signed the “Waiver of hearing” (Not to see the judge) in front of Mr. Warren D Coxon, ICE Agent in Haskell TX.
On 29th of April 2009, he spoke to ICE Deportation Officer Mr. Dan Deweese and Mr. Arron Nation, Dallas TX for further Process.
Why did he not sign the deportation agreement:
In the next couple of days after arresting him and keeping him at GEO detention center at San Antonio TX, the ICE agent Mr. Jose Flores called and spoke to Sunitha Shivaram, as he had mentioned her reference in the I-539 transfer application. After his arrest by ICE, she advised him not to sign any deportation papers. She also called Mr. Jose Flores on his cell phone on 4th of September 2008 at 1640 hours and became agitated and called him a liar. The ICE had then charged him with a criminal court case for providing false information in the I-539 visa transfer application. She also assured him that she would provide him with a private attorney and also to take care of his commissary expenses at detention. After which she was unable to hire an attorney for him. Thus she was helpless in providing any kind of support and help.
F1 student visa by Grayson County College at Sherman TX:
His L1 work visa had a expiry date of march 2008 (In his I-94 issued at NY airport), thus the Grayson County College (Ms. Amanda Venn, International Students Counselor) applied on his behalf for his visa transfer from L1 work visa to F1 student visa in the month of January 2008. His visa transfer application was accepted and APPROVED in august 2008 by the Homeland Security (USCIS).
On 24th of July 2008 he also encountered a visitation and verification of his legal documents like passport, visa, drivers license, etc, by the Sherman TX FBI Agents (Nikki Hampton, Ken Paith, Michael Kerenek) who were misinformed by Ms Zona Sanders (903-870-1635, 337-348-3435) an employee of Stonebridge Motel at Sherman Tx. On the night of this same day he was injured by a person, who had hurt him with bloody bleeding injury on his nose. He thus asked Ms Ellen Beagles (employee of Stone Bridge Motel at Sherman TX Tel:903-868-0555) to call 911 for self protection. Then the Sherman sheriff came and verified the person and recorder his voice statement, but he did not impose any criminal charges on him. The very next day after this incident Mr. Mahesh Gopalakrishna (CEO of Stone Bridge Hotels, a friend of his) asked Mr. Cleveland Harris to help him vacate the motel room as a preventive measure. Due to this sudden and unexpected change of address he received his visa approval letter at Dallas TX on 23rd of august 2008.
He was supposed to join his college in spring (December 2008 or January 2009):
He had received his F1 student visa approval in hand by usps on 23rd of august 2008, as he had changed his address from Sherman TX to Dallas TX. Thus he intended to join his college for education in spring semester (December 2008 or January 2009) as the last date for registration for the FALL semester was 21st of august 2008. He met Ms Sonal Goda Realtor (703) 863-0031 through web portals meetup.com groups. She is a nice person from India, thus he looked upon her as his sister with respect and compassion. She eventually invited him to stay with her family so that he could do proper enquiry regarding Stratford and Woodbridge colleges for his masters programs. As the Grayson County College does not have a masters program.
Credibility of L1 visa issued in India:
The pre-approved blanket petition non-immigrant L1 visa was issued to him in India by the Honeywell in the year 2005 and the same was approved by the United States Embassy in India. He could not notice any fraud when he personally went to United States Embassy in India for approval. Thus he had no reason to doubt the genuine credibility of L1 visa. As he was not aware of any kind of visa frauds, he has answered with a check mark under the “NO” column, under part 4 for question 3E of form I-539 visa transfer application, as alleged in the criminal charges by the ICE in the United States Eastern District Court. As he was not aware of any alleged fraud, of non-immigrant L1 work visa, which would violate the terms of the non-immigrant status.
Misguidance by the Honeywell Employee:
In the year 2005 the Honeywell Employee who issued Mr. Kargudri the L1 visa told him that the visa was a nonimmigrant L1 visa blanket petition, which was pre-approved in the year 2004. He told him that he would transfer the same into his name in the year 2005. He told him that the Honeywell had already invested financially in the process of approval and thus it would like to give the same to him, so that it would regain the visa approval financial fees. He told him that he would be working as a temporary consultant and not as a permanent employee, as Honeywell was no longer recruiting any permanent employees due to a weak economy and lower job openings due to insufficient funds. Thus he told him that he would be paying him in Indian rupees back in India for his consultation charges for the technical projects matching his skill sets, eventually it was not paid. After three years on 26th of August 2008 he was informed by the FBI and ICE agents at the San Antonio airport that the L1 visa issued to him in the year 2005 was a fraud. Thus he realized that the Honeywell Employee in the year 2005, back in India, had lied to him, and had also misguided him by issuing him a fraud visa and there after misusing his valuable technical talents, recommendations and solutions for his own self interest.
His job responsibility at United States:
After coming to United States, he was involved in providing valuable technical software guidelines, recommendations and solutions as a consultant to the Indian Honeywell Employee who was in India. Thus his consultation fees and payments were paid in Indian rupees back in India. Thus he has provided the statement under the additional comments for question 3G under part 7 of the form I-539 visa transfer application, as mentioned in the indictment. Simultaneously at the same time he was awaiting for allotment of available projects from Honeywell in United States matching his technical skill sets. He could also see, in reality that there was a recession in the United States job market, as many organizations were laying off the employees. The news media too reported that economy in United States was broken and the citizens of United States were facing a slow down in economy.
Reference of Sunitha Shivaram in I-539 application:
The person in India who had issued him the L1 visa in the year 2005 was no longer employed with Honeywell when he was applying for his visa transfer from L1 to F1 in January 2008. Thus after approval from Ms Sunitha Shivaram, (Sunray Corp, Atlanta Gorgia. Tel:678-584-1312) he had mentioned her reference to the homeland security (uscis), if in case they would contact her for any clarifications, she would give them an truthful statement with a clear and proper understanding which would be helpful in visa approval. Thus her reference as a perspective future H1B sponsor for his employment in United States was provided to Homeland Security in order to help facilitate proper guidance and understanding of the existing situation.
Plead recommendation by Federal Defender Ms Denise Benson:
On 2nd of December 2008 his court appointed federal defender came to meet him for the first time at Hunt County Detention and advised him to sign the plead agreement, asking him to accept the false swearing in immigration matters. This was the first time ever, she came to visit him, as she never spoke to him on telephone nor she ever wrote any letters to him. On this day she also handed over his discovery documents to him personally. She told him that it was not possible for her to prove him as innocent, as they did not have sufficient evidence of witness to establish his employment with US Honeywell. She told him that by signing the plead agreement he will be getting an advantage, a reduction of two points and thus, after completion of six months in detention will be deported back to India. The other reason being, Ms Sunitha Shivaram was unable to provide a private attorney. As he was financially not consistent to fight against the federal system all alone, thus he thought it was better for him to sign the plead agreement and thus return back to India as soon as possible. On 13th of January 2009 he plead guilty at court in front of Judge Don Bush. On 20th of February 2009, he underwent a PSI interview with probation officer, Ms Christin Cormier (an assistant of Mr. Paul Hennen).
Request for a secured employment in India:
He requested the honorable court to do justice by providing him his basic rights of secured employment in the field of civil engineering and information technology matching his work experience and technical skill sets. It would be a great help if the court would guide the concerned authorities in India to provide him with a secured job where in he can get the medical, health, retirement and insurance benefits. It would help him in achieving his good purpose to lead a humble life with dignity and respect. Thus we humbly request the honorable court to bless him and guide him to a permanent secured employment with some of the Indian concerns like, public work department, Educational and University Departments, green and alternative energy departments, Religious and Spiritual peace orgs, Department of National Highways, Child care, Orphan and Old Age Homes, Nature Protection, Geological, Wild Life and Forrest Departments, Hydrology and Power transmission, Pollution and waste management departments.
His Role and Objective in this situation:
His only intention and motive was to peacefully and constructively resolve the court case as soon as possible, without wasting the precious time and revenue of the justice department. We humbly seek, pray and request the honorable court to grant him with an opportunity to fulfill his humble objective and a good purpose of life to continue with his education in this great nation of United States, he thus intend to be a calm, gentle and humble citizen, who would seek and pray to achieve his good objective in life with dignity and respect.
In the present situation he was financially poor and weak, at the same time he was well educated and came from a good family background in India. He has struggled hard all his life to lead a noble life with dignity and respect. He completed his Bachelors of Engineering back in India, in the year 1996, with a total education of 16 years. He is a simple man who believes in hard work with a good purpose of life. He is an optimistic man who very much believes in love, compassion, patience, hope, faith and freedom. But as of today he is a living example, suffering with false charges of fraud and perjury. An innocent person like himself, have been framed as a victim in this situation. Thus it is necessary to make a clean and clear investigation of actual facts and analysis of truth. It has been a constant struggle in his life to heal, cure and rectify the mismanaged systems. It is the persistence to be constructive, without frustrations to achieve a good purpose of his life. Thus the truth is the power which prevails under critical situations. His only intention is to protect the courts decision from doing any injustice to the innocent week people like himself who have suffered the basic human rights of food, shelter, dignity, respect, identity and appreciation. The good and innocent people must be respected and appreciated, as good things are contagious too. He has worked very hard just to make little money as to survive and fulfill his basic necessities which is neither a sin nor a crime, when inflation was high, job market was low, gas prices were high and the economy was broken. Instead of appreciation his hard efforts some have criticized him with a false charges of fraud and perjury, which is definitely an injustice. We request the honorable court to do justice with utmost respect and dignity.
He comes from a poor country, where in things are miserable. We still remember the helpless situation, he faced back in India. In the year 2005, as his father had a sever heart attack due to a heavy loss in his business. His mother, sister, and all his uncles and relatives stood helplessly with misery, thus none would help him. In such a helpless situation one of his friends introduced him to a person who helped him out with this L1 work visa. He had lied to him by telling him that his L1 visa was original and genuine. He later came to know that it was a fake and he was a victim of this situation. He had misguided him by telling a lie. He was unable to see his name anywhere in the investigation report. He visa issuer was rich, influential and had bribed the corrupt officers in India to hide his name from the whole situation scenario. Poor, innocent, helpless, miserable people like him have been the victims of this entire case. Like him he has fooled and misguided several tens and hundreds of people and companies.
India is a very typical example of poor developing countries where in poverty and population has given rise to unemployment. This has led to mismanagement, corruption, manipulation and pollution to name a few. Eventually leading to loss of quality life, character of people, health, moral values and discipline in life, of its citizens. People have adopted wrongful ways to achieve their bread and butter to feed their families basic necessities leading to loss of trust, faith and optimism. This has lead to cultural imbalance and religious superstitions. Under such sever circumstances he had lost all his property, his father and his job.
Here are a few simple and common sense questions, which arise in our minds, which are to be answered by the immigration authority.
There are millions of illegal immigrants in US who do not have any documentation and do not know to speak English. Apart from them there are millions more immigrants like him who are working in US with a L1 work visa issued by immigration authorities who are never questioned by this authority.
Why did the immigration deport him before deporting these millions of illegal immigrants? Comparatively he is not the worst of all these illegal immigrants. In fact he is one of the best of all the legal citizens.
He is not the real culprit but one of the victims of the corrupt immigration system who issued him a visa by making corrupt money. He was wrongly assured of the genuine visa by the issuing authorities. He was innocent and never had any doubt nor suspicion of any visa violations.
